I heard they can not do anything because the check you wrote them in the first place was all ready a bad check? My friend is crazy and thinks he knows all so I want to know the truth so I can prove him wrong so please answer quickly and truthfully. Thanks.

    The papers you sign make it a loan. They can totally ***** your credit, sue to garnish wages. Do never test the loan sharks of payday loans.

    They make you post date the check as well as sign a contract. Contract if properly written are binding.

    Last I heard writing a bad check was still against the law. They can go for breach of contract. An advance is nothing more than a loan with a promise to repay.

    What happens is they take you to civil court it is not a felony ,they dont issue no warrants and they place a judgement against you and you have to pay back-if your dont pay judgement it puts a mark on your credit and they will garnish wages (in some states)and get it back -point is ,it has nothing to do with the law-its a loan they handle it in civil court-dont get messed up with the payday loan stuff -it very hard to get back out of the hole.

    You win! Your boyfriend's view makes no sense. A cash advance must be repaid or it will likely be sent to collections and you may be sued if you do not pay. I do not know any way you can get out of it short of filing for bankruptcy.

    These places make a mint on the interest they charge. And the longer your friend doesnt pay, the more interest that is accumulating. They have the ability to have wages garnished, then charge for legal fees incurred to colelct the debt, etc.
    Your friend is screwed.
